The purpose of the site is to offer cosmetic products for sale (hereinafter referred to as “Products”) to consumer and professional buyers.
Comette Cosmetics products are cosmetics intended for external use. Under no circumstances should the information given on our products, our website or our commercial and advertising documents replace the advice of a health professional.
Prices include VAT applicable on the date of order. Should the rate be modified, these changes may be passed on to the customer without prior notice.
Product offers and promotional offers, mentioned as such, are valid as long as they are visible on the site and available in stock.
Promotional codes are valid until the date indicated by Comette Cosmetics.
The prices and special offers proposed on the Site are valid only for products sold on www.comettecosmetics.com and do not apply to products sold in stores or on other Internet sites, and vice versa.
Article 1 – Purpose
The present conditions govern the sale of cosmetic products by Comette Cosmetics 3, rue du 18 Juin 1940, 26770 TAULIGNAN, FRANCE.
Article 2 – Prices
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), including processing and shipping costs. All orders, whatever their origin, are payable in euros. Comette Cosmetics reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is validated, subject to availability. The products remain the property of Comette Cosmetics until full payment has been received.
Warning: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
Article 3 – Ordering
You can place an order on our website or by post, detailing the name of the product(s) you wish to purchase as well as the quantity and enclosing a bank cheque for the corresponding amount to the following address: Société Comette Cosmetics, 3, rue du 18 Juin 1940, 26770 TAULIGNAN, FRANCE. The cheque should be made payable to Comette Cosmetics. The company Comette Cosmetics reserves the right not to register a payment, and not to confirm an order, in particular in the event of shortage of stock on the product concerned.
Article 4 – Validation of your order
Any order placed on the https://comettecosmetics.com website implies acceptance of these General Terms and Conditions. Any confirmation of an order implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation. All data supplied and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of them. Confirmation of your order will constitute your signature and acceptance of the operations carried out.
Article 5 – Payment
The fact of validating your order implies for you the obligation to pay the indicated price. Payment is made by credit card using the Atos-LCL secure system.
Article 6 – Withdrawal
In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty. Returns must be made in their original, unopened condition. In this case, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. Return shipping costs are at the customer’s expense. In the event of exercising the right of withdrawal, Comette cosmetics will reimburse the sums paid, within 14 days of notification of your request and via the same means of payment used at the time of ordering. Article 7 – Delivery
Products are delivered to the delivery address indicated during the order process, within a maximum of 15 calendar days from the validation of your order. In principle, we dispatch orders within 48 hours (working days). In the event of a delay in shipment, you will be informed by e-mail. Comette Cosmetics cannot be held responsible for any delay in delivery caused by La Poste.
Article 8 – Liability
Comette Cosmetics shall not be held liable for any damage resulting from improper use of the product purchased, the use of which is recommended on the packaging. Likewise, Comette Cosmetics shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
Article 9. Legal warranties
The Vendor undertakes to provide the Customer with a good or service that complies with the Customer’s request.
In any event, for tangible goods, the Customer may avail himself of the legal guarantee of conformity provided by the French Consumer Code, in particular articles :
Article L.217-4 of the French Consumer Code :
“The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility.
Article L.217-5 of the French Consumer Code :
“The property conforms to the contract:
1. whether it is fit for the use ordinarily expected of similar goods and, if so :
if it corresponds to the description given by the seller and has the qualities presented to the buyer in the form of a sample or model:
it has the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling
2. Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller’s attention and accepted by the latter”.
Article L.217-12 of the French Consumer Code :
“The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods”.
The Vendor also remains liable for any redhibitory defects in the item under the conditions set out in articles 1641 to 1648 paragraph 1 of the French Civil Code:
Article 1641 of the French Civil Code: “The Vendor is liable for any hidden defects in the item sold which render it unfit for the use for which it was intended, or which diminish this use to such an extent that the purchaser would not have acquired it, or would have paid a lower price for it, had he been aware of them.
Article 1648 paragraph 1 of the French Civil Code:
“The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect”.
Finally, article L.217-16 of the French Consumer Code stipulates that :
“When the buyer asks the seller, during the course of the commercial warranty granted at the time of purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer’s request for service or from the date the item in question is made available for repair, if the item is made available after the request for service.
When the customer acts under the legal warranty of conformity, he has a period of two years from the date of delivery of the good to act. He may choose between repairing or replacing the good, subject to the cost conditions stipulated in article L. 217-9 of the French Consumer Code. He is exempted from having to prove the existence of the lack of conformity of the good during the twenty-four months following the delivery of the good.
The legal warranty of conformity applies independently of any commercial warranty that may have been granted.
The customer may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code. In this case, the customer may choose between rescinding the sale or reducing the purchase price in accordance with article 1644 of the French Civil Code.
Article 10 – Applicable law in the event of disputes
The language of the present contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 11 – Intellectual property
All elements of the www.comettecosmetics.com website are and remain the exclusive intellectual property of Comette Cosmetics, as is the Comette Cosmetics logo. The brand and its logo are registered with the INPI. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether photographic or textual, without citing the source.
Article 12 – Personal data
Comette Cosmetics reserves the right to collect nominative information and personal data concerning you. This information is necessary for the proper management of your order. It may also be transmitted to companies that contribute to this relationship, such as those responsible for the management, execution, processing and payment of services and orders (e.g. La Poste). This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.
Article 13 – Archiving Proof
Comette Cosmetics will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.
